Summary of Class Action

Update August 2024: Deficiency notices issued. Claims that are missing documents required under the Settlement Agreement were sent a deficiency notice via email and mail. The deadline to respond to your deficiency notice is September 7, 2024. Failure to respond could result in your claim being denied.

Update June 2024: Claims Period closed on June 3, 2024.

As of February 1st, 2024, settlement class members could submit claims for reimbursement of Past Repairs to the Claims Administrator. The Claims Period Deadline to submit a claim for reimbursement was June 3, 2024 and is now closed. No new claims for reimbursement are currently being accepted. An Eligible Claimant who requires a repair or replacement under the Extended Warranty provided in the settlement can bring their Eligible Vehicle to an Authorized Volkswagen or Audi Dealership, depending on their Eligible Vehicle. To obtain the Extended Warranty, you do not need to submit a claim.

On December 1st, 2023, the Saskatchewan Court granted approval of the nationwide settlement to resolve claims in Canada related to allegations that the primary engine water pump in certain Volkswagen and Audi vehicles is defective. Copies of the Court Order approving the settlement can be found here.

Beginning February 1, 2024, the Claims Administrator issued the Approval Notice via email and mail to potential class members who are in Volkswagen’s, Audi’s, or class counsel’s records or registered for updates with the Claims Administrator, along with advising media through a press release.

If you have an Eligible Vehicle that previously suffered a failure of its primary engine water pump within the following periods, you are required to submit a claim for reimbursement to the Claims Administrator. The documentary requirements include: (1) Proof of Ownership, (2) Proof of Repair Expense, and (3) Proof of Adherence to the Vehicle Maintenance Schedule:

  • For Eligible Vehicles with 2008-2014 model years, 10 years or 160,000 kilometers, whichever comes first; or
  • For Eligible Vehicles with 2014-2021 model years, 8 years or 125,000 kilometers, whichever comes first.

A nationwide settlement has been reached with certain current and former owners and lessees of Volkswagen and Audi vehicles (the “Settlement”). This Settlement was reached following negotiations among Volkswagen, Audi, and class action lawyers for the owners and lessees. The Settlement has now been approved by the Court.

The class action provides for damages and other relief on behalf of consumers with affected vehicles, alleging that the primary engine water pump in these vehicles is defective. The primary engine water pump means the primary coolant module including the engine water (coolant) pump and the controller unit.

Volkswagen and Audi have agreed to offer in Canada the following benefits under the Settlement:

Am I Included in the Settlement?

You may be included in the Settlement if:

  • You own/owned or lease/leased an Eligible Vehicle; and
  • You are a Settlement Class Member.

Only Eligible Vehicles are included in the Settlement.

You may have an Eligible Vehicle if it is included in the below list of vehicles:

In addition, Eligible Vehicles:

  • Must have been originally sold or leased in Canada; and
  • Must be confirmed, by reference to their VIN, to be an affected vehicle.

Benefits Available Under Settlement

If an Eligible Vehicle previously suffered a failure of its primary engine water pump within:

  • For certain 2008-2014 vehicles, 10 years or 160,000 kilometers, whichever comes first; or
  • For certain 2014-2021 vehicles, 8 years or 125,000 kilometers, whichever comes first.

YOU MAY HAVE A CLAIM for repair and/or replacement of the primary engine water pump or repair and/or replacement of an engine due to failure caused by a failure of primary engine water pump.

An extended warranty with the same time and mileage durations as set out above will be applied to your vehicle.

What are My Options in the Settlement?

1. PARTICIPATE IN THE SETTLEMENT

If you wish to obtain benefits under the Settlement, there are two possibilities available (only one can apply):

Reimbursement Claim: For Out-of-Pocket expenses paid before February 1, 2024, for repair or replacement of the Primary Engine Water Pump or failed engine directly caused by a Primary Engine Water Pump Failure, you must have submitted a claim by June 3, 2024.

Extended Warranty: If you suffer or suffered a repair or replacement of the Primary Engine Water Pump or failed engine directly caused by a Primary Engine Water Pump Failure after February 1, 2024, but still within the time and mileage parameters under the Extended Warranty period, you must visit an Authorized VW Dealer. *Note you are not eligible to reimbursement if you pay for repairs completed after February 1, 2024.

2. DO NOTHING

If your Eligible Vehicle has not suffered any issues covered under the settlement, you do not need to take any action. The Eligible Vehicle is automatically included under the Extended Warranty provided under the settlement.
